TERMS OF SERVICE
Before proceeding with a commission, it’s essential for both the artist and the client to ensure mutual understanding to prevent any miscommunication. Please take a moment to carefully review these terms!By commissioning me, you are agreeing to the following terms:
I. Engagement
The client is required to provide clear and complete references or assets relevant to the commission, along with a detailed explanation of the request, before any work starts. Additional elements submitted later may incur extra charges.
If the client cannot provide sufficient visual references, a design fee may be applied to the final price. For example, a Pinterest mood board might result in a design fee, though this will be assessed on a case-by-case basis.
Please be aware that instructions such as "have fun with the design" or "feel free to tweak it" will be considered part of the design process and may involve additional costs.
The artist reserves the right to decline commissions based on subject matter, content, or other considerations.
Clients should note that the artist works in a specific art style and will not alter their style to imitate another artist's work.
Changes to the request are allowed only if the work has not yet started. Clients may upgrade their commission (e.g., increasing from a €10 commission to a €20 one), but downgrades are not permitted.
Refunds are not available once the work has begun unless initiated by the artist.
II. Content restrictions
The artist will not produce content that is offensive or inappropriate. Discussions with the client are required for explicit works to ensure clear boundaries and understanding.
The artist will not create the following: hardcore adult content, NSFW involving underage characters, extreme muscular depictions, imitation of another artist's style, heavy mecha, or furry artwork.
The artist is open to creating softcore adult content, such as depictions of lingerie, soft nudity, or mild intimate scenes. Clients are encouraged to discuss these subjects privately for further clarification.
III. Timeline & process
Estimated Completion Times:
Up to 2 weeks for standard projects (e.g., Bust up, Hallf bodies, chibis, etc.).
Up to 1 month for larger projects (e.g., full illustrations, full bodies, or detailed rendered artworks).
Completion timelines may vary depending on factors such as complexity, type of commission, and the artist's workload. Clients are advised to plan events like launches or streams accordingly.
The artist may work on commissions out of the order in which they were received. Since inspiration can be unpredictable, the artist prioritizes creativity and quality over speed to ensure the best results for each project.
In the event of delays due to personal circumstances, the artist will update their client via instagram DMs or e-mails to keep them informed.
Final deliverables:
Completed works are typically sent via email.
For files too large for email, delivery will be handled through Google Drive.
Please note that the artist usually handles emails on open days (Mon-Fri)
IV. Revisions
Once the linework phase begins, only minor adjustments (e.g., small color corrections or a single-layer detail) will be permitted without charge. Major changes (e.g., repositioning, adding/removing elements, or adjustments involving multiple layers) will incur a fee ranging from €5 to €15, depending on the complexity.
Additional charges beyond €15 may apply for excessive revisions.
If the client has any specific request (for example: a specific pose); please state it beforehand. Asking for a whole pose change after the sketch has been worked on will sadly fall into "excessive revisions" and charged a fee, as indicated above. This applies to anything that require restarting the work from scratch due to a lack of clear communication on the client's part.
Please note that revisions may impact the progress and overall timeline of the commission. Please note that revisions may impact the progress and overall timeline of the commission.
V. Communication
Communication regarding the commission process will take place via instagram DMs with the client ONLY.
The artist’s response time may vary to ensure quality updates. Replies might not be immediate, especially during weekends, as the artist may not work on those days.
Clients are kindly asked not to spam or bring up unrelated topics to expedite responses. Keeping the conversation focused on the artwork is appreciated.
Please understand that the artist is likely managing multiple commissions simultaneously. A lack of updates within a two-week period is typically normal, as creating art is their full-time job.
If you have questions, please review these terms first, as the artist has carefully detailed them to minimize miscommunication.
VI. Rights & usage
Artist rights:
The artist retains full copyright, ownership, and intellectual property rights over the commissioned work. This includes, but is not limited to, rights for display, advertising, printing, and sharing progress or completed works on websites, social media, portfolios, public broadcasts, and other platforms.
If the commission involves a character not owned by the client (e.g., a Lux headshot from League of Legends), the artist reserves the right to use the artwork for purposes such as creating merchandise (e.g., keychains or pins).
Client rights:
Clients are granted exclusive, non-transferable rights to use the commissioned work for personal purposes only. For commercial rights, please refer to the next section.
Personal use includes:
Displaying the artwork on social media for non-monetized purposes, such as profile pictures, banners, or posts. The CREDIT must be VISIBLE and CLEAR
Printing and framing the work for personal spaces.
Clients must not claim the artwork as their own. When sharing or displaying the work, they must credit the artist appropriately using their social tag, username, or link. This credit must be displayed either where the work is showcased or permanently on platforms like websites, social media profiles, or broadcast channels.
Clients may not edit or modify the artwork in any way without prior permission from the artist.
VI.2 Commercial usage
Commercial usage rights are not included unless explicitly specified in the commission type, as listed on the artist’s website (e.g., Logos, merch designs, emotes, etc.) or agreed upon beforehand.
Definition of Commercial Usage:
Using the commissioned work in streams, videos, or other monetized content.
Selling or reselling the work as part of a product or on any platform.
The use of commissioned artwork for AI tools, platforms, or programs, as well as for NFTs, blockchain, or other profit-driven platforms, is strictly prohibited.
Additional fees will apply for commercial usage if it is not included in the initial agreement. Refer to [this document] for detailed rates and conditions.
Note: Collaborations must be discussed directly with the artist, do not refer to the terms outlined above.
VII. Payement & fees
All payments must be made in € (EURO) or CHF (SWISS FRANC).
Clients are required to pay in full before the commission begins unless a payment plan has been agreed upon. No work will commence until payment is received.
For orders exceeding €150, payment plans are available and can be discussed with the artist.
Invoices and Payment Methods:
A Stripe invoice will be sent to the client. Clients should not send payments before the artist requests it unless it is for a donation.
The artist primarily uses Stripe but is open to alternative payment method such as bank transfers (IBAN).
Invoices must be paid within 5 days, unless a different timeline is agreed upon. Failure to pay on time may result in the project being canceled, and repeated non-payment may classify the client as a "timewaster," potentially preventing future commissions.
Fees and Pricing Details:
Prices displayed on different platforms (e.g., Carrd, Fiverr and VGen) may vary due to differing platform fees.
If the client requires a deadline of less than 1 month, a rush fee ranging from €30 to €100 will apply, depending on the artist’s workload and the commission’s complexity.
Depending on the commission’s complexity (e.g., long hair, intricate outfits, or armor), the final price may vary. Detailed pricing ranges can be found on the commission prices page.
Final Product and Delivery:
Clients acknowledge that once work begins and payment is made, the final product will be digital. No physical goods will be shipped unless the commission involves a traditional artwork.
VIII. Confidentiality
Clients must provide certain details, such as their legal name and country, in the commission form to allow the artist to issue valid business invoices. These invoices are necessary for the artist to prove compliance with legal income requirements. Failure to provide this could have serious legal consequences for the artist.
If clients are uncomfortable sharing this information, they may opt to commission the artist through VGen, which acts as an alternative but includes an additional fee.
Both the artist and the client agree that any shared information or materials (e.g., personal details, payment information, or other sensitive data) provided during the commissioning process will be treated as confidential.
Such information will not be made public or disclosed to any third party without the explicit written consent of the information’s owner.
